I, here by, declare that the above particulars are true in every respect, undertake responsibility to work diligently and to be honest in my dealing with the public and the company. I have also read the terms & conditions laid down for the enrollment of marketing member overleaf. I have gone through the rule book, literature of the company and shall abide by the stated rules, terms & condition. I know that once starter product kit sold is not returnable and not replaceable. I am committed to pay any type of fee, service charges etc. that will imposed on me by the company in future. The same fee will not be refundable. The above statement has been explained to me in my language and I understood that I/we certify that the information provided herein is correct to the best of my/our knowledge.

I/We know & understand well the language (English) in which the Terms & Conditions of agreement are written & also know the value of online agreement so I/We have no doubt to understand & am/are agreeing with my/our full willingness, Consciousness & full satisfaction .

1. I /we am/are an adult person's & legally competent to enter into business
2. I /we shall become a SSPL DISTRIBUTOR upon acceptance of this application. I /we shall have the right to promote the products offered by SSPL in accordance with its direct selling system, rules, regulation, policies & procedures framed by the company from time to time.
3. I /we have carefully review the SSPL business plan rules, regulations policies & procedure and acknowledge having studied the same & unconditionally agree to the same being modified from time to time. I /we have also read the same on the notice board of the registered office or and authorized branch of the company and agree to the same in total.
4. SSPL at its discretion may amend the business plan rules, regulation, policies, and procedures and terms and conditions of this Representative Application/Enrollment form and shall notify its distributors of any amendments, alterations, deletions and additions, which will be binding on me/us.
5. Upon acceptance of this application by SSPL, I /we will be an independent distributor responsible for my/our business & not as an employee of SSPL. I /We will not be treated as an employee in regard to any labour laws & shall not claim any E.S.I., P.F., Gratuity or any other benefits under any act presently in force or such act which may come into force from time to time, including the workmen's compensation Act and such other allied labour laws.
6. I /We also understand and agree that my/our status as a distributor in the business plan of SSPL is valid commencing from the date of application to be enrolled as a Distributor from the date of acceptance of application & shall be renewable each year on payment of such sums as the SSPL may decide from time to time. Renewal fees will be adjusted in commission amount or to be paid by cash/D.D.
7. If I /we sponsor other distributor, I /we must fulfill the obligation of performing a bonafide supervisory, distributing & selling function in the sale of product to the ultimate consumer and in the training of the distributor. I /We must maintain close liaison with distributor sponsored by me/us.
8. I /We will be responsible to pay all the tax dues regularly, whether local, state & central, on earnings from incentive generated in particular financial year
9. I /We will not use the SSPL trade name and/or trademark except in the advertising provided to me/us by SSPL, neither shall I/we advertise the product and/or SSPL on my/our own. I/We am/are however permitted to promote the same through personal contact, and word of mouth.
10. I /We understand that the SSPL Business Plan is program built on retail sales of products to the ultimate consumer, thereby avoiding middlemen & passing on the benefits of such direct sales in the form of sales incentives to the distributor.
11. Prior written approval from SSPL is required to use or produce any literature other than company produced literature relating to the products, company, or Business plan
12. I/We understand that only a representative of the SSPL who has received training, and has an identity number in the company stating the same; can make a public presentation of the SSPL Business Plan.
13. I/We agree that, all matters are subject to Pune Jurisdiction only
14. This agreement will be binding upon receipt at the company registered office, and upon the acceptance thereafter by SSPL.
15. This agreement constitutes the entire agreement between the Distributor and SSPL and no other additional promises, representations, guarantees or agreements of any kind is valid unless in writing & approved by SSPL.
16. All Terms & Conditions applied in present & Terms & Conditions applied in the future by the company will be strictly applicable on me/us.
17. The amount towards product and processing fees has to be paid only by cash/D.D.
18. The validity of Receipt is subject to realization of P.O. /D.D.
19. The DISTRIBUTOR shall to display the SSPL name, logo, as designed by the company for printing his/her personal stationary (with prior permission). However the distributor shall not use the trademark or any other intellectual properties of the company for any other purpose other than for promotion of the business of SSPL.
20. Upon death of the Distributors, the right & responsibilities of the distributor are passed on to the rightful nominee as per the law. The nominee shall be bound by the terms & conditions of the original Distributor agreement and abide by the company's rules and regulation.
21. The company has the right to terminate any DISTRIBUTOR without giving prior notice.
22. After termination, any type of cash, Product & any type of other Dealings by me on behalf of company, will be counted as a serious & Punishable offense. & I/We could be punished also. And on release of public Notice of my Termination by the company through any Media, I/We will have no objection in any condition.
23. The management of the SSPL reserves the right to reject any application without assigning any reason.
24. Company would not be held responsible if due to act of God/calamity/Change in regulation, changes in law or due to any unforeseen circumstances it is not be able to perform its normal working & under such circumstances DISTRIBUTOR'S and except that no claim would be presented or entertained.
25. Distributor will not be allowed to collect the part/full principal amount on behalf of the company, as the company has its own office & separate department for their customer to guide & help in all aspect.
26. If any Independent Distributor has any query/dispute regarding the payment of commission, the independent distributor should contact the company's head office within 15 days from the date of dispatch of cheques from head office else the data for the previous month shall be considered as accepted.
27. TDS will be deducted on income as per the income tax rules.
28. The closing of business will be on monthly basis
29. One pair means one sale of Initial starter Product Kit from right leg & one sale from left leg
30. On non-availability of any product provided in starter kit, company can exchange to another product of same worth.
31. Company will deduct and issue the credit voucher of 5% of total income of a month. The validity of the credit voucher will be 90 days from the date of issue
32. For & against any payment, Cash/Demand Draft only will be accepted, Payable at Pune in favour of Sunway Sales Pvt. Ltd.
33. Maximum limit (Capping) of pair incentive per distributor in a Week is up to Rs.25000/- for the joining option less than Rs.6000/- is for beginners joining amount exceeding Rs.6000/- is for professional marketing personals & make avail the facility of commission of Rs.40,000/- weekly basis only for pair plan
34. Only Single ID will be issued to single person.
35. Eligibility of PPP Income is to Enroll at least direct 3 Distributors (One in left, one in right & third one in any of the side) Minimum common PPP Obtained from any leg only will be counted for payout of that closing
36. Write clearly name & Id number on backside of D.D. (company will not be responsible for any incorrect information provided by you).
37. Company will not be responsible for any fake commitment made by any of its distributor.
38. Eligibility of getting spillover benefit is, appointing at least two distributors directly (one in left & one in right).
39. Minimum generated payout Voucher Rs.300/- will be paid
40. Supplementary credit voucher will be issued for the amount less than Rs.100.
41. The agreements shall constitute the entire understanding of the parties with respect of the subject matter. The agreements may be amended at any time in writing distributed by Sunway should any inconstancies arise, all of the terms & conditions of these policies and procedures will be as amended at that time.
42. Once starter product kit sold is non-returnable & non-replaceable in any condition what ever case may be..
43. All cash payments can be made only at company’s Regd. or Head Office during office timings. Company will not be held responsible for any cash payments made at any other place.
44. All tax liabilities / transportation charges will be borne by distributors
45. The PV of the Starter Product kit issued at the joining will be decided by company & reserves the right to change time to time.
46. The renewal will be charged annually, as per the company's rules and regulations.
47. Your arrangement with the company is purely linked with your performance.
48. To get monthly commission, the purchase of the products of worth Rs.200/- is mandatory
49. The Company is free to go out of its own Rules & Regulation any time or any where without explaining any reason.
50. It is brought to you under notice that any kind of incentive/Reward achieved will be paid /given after the normal completion of stipulated time of achievement of that reward. It doesn’t matter that you have achieved within short period. He/She should approach office & tell about his/her last performance weekly.
51. The Distributor always will get on any of the product 5% less from M.R.P whenever he purchases
52. Also it is to be noticed that our payouts of commission vouchers are monthly basis. And strictly the closing of business is last day of the month.
53. The commission Voucher will be released within minimum of 10 days, maximum of 15 days, and in some unforeseen & typical conditions like natural calamities etc. it might be 30 days & above from the closing Date of month.
54. The Company will not be responsible for any kind of personal declaration or commitment made by any Distributor/Leader under his/her or other’s Group.
55. As per the Company’s norms the Company will charge a fix sum of Amount as a renewal subscription yearly
56. As a distributor if you are paying left of or full amount related to Renewal between grace period of 90 days (after 15 days, 30 days, 45 days, 60 days or 85 days). The commission generated on your ID No. or Id. No. of any Distributor at this place will not be paid the commission of this period Started from 365th day & the day until renewal is paid before 90th day.
57. For the delay in payment of commission voucher or any incentive, just because of improper & wrong information filled by Distributors in enrollment form, the Distributor him/herself will be responsible.
58. All Distributors are restricted by all rules & regulations, issued by company time to time. It is Distributors duty to know & learn or read carefully the Terms & Conditions of business opportunities. Not knowing the Terms & Conditions is not an excuse.
59. The closing of the business is weekly basis; the payout will be released by weekly
60. All actions & proceedings are subject to Jodhpur jurisdiction.
61. One pair means one sale of Initial Starter Product Kit from right leg & one sale from left leg.
62. On non-availability of any product provided in Starter Product kit, company can exchange to another product of same worth.
63. Company will deduct and issue the credit voucher of 10% of total income of a month. The validity of the credit voucher will be 90 days from the date of issue. TDS will be deducted as applicable. Rs. 30/- will be deducted as a courier charges from every voucher.
64. For & against any payment Cash/Pay Order/Demand Draft only will be accepted payable at Jodhpur in favour of "Sunway Sales Pvt. Ltd".
65. Maximum payout of pair income restricted maximum up to Rs.50000/- in a month, excluding other income plans.
66. Single Id will be issued to single person only. Rs.500 will be charged on the transfer of name on that particular ID. No. On behave of requested application and with consent of NOC by up line ISD’s.
67. To get pair income it is mandatory for a distributor to sponsor two direct distributors, one in left & one in right group.
68. The Company reserves the rights to Change, Close; exchange any income plan, Incentive, Rewards, product kit & products etc. without giving any prior notice to ISD’s. Company’s decisions on any matter will be final.
69. Write clearly name & Id number on backside of D.D. (company will not be responsible for any incorrect information provided by you).

71. Applicant, joining the company, must be of 18yrs & above age.
72. Eligibility of getting spillover benefit is appointing at least two distributors directly (one in left & one in right)
73. Rewards are totally based on performance of Independent Sunway Distributors.
74. To get monthly commission, it is mandatory to make a purchase of product of worth Rs.200/- in a month.
75. Product option kit or any product, once purchased from Sunway, will not be replaceable or taken back in any condition.
76. No payout will be paid less than Rs.200/- at any payout released i.e. Minimum Rs.200/- generated payout will be paid.
77. The company reserves the right to terminate the Independent Sunway Distributor if he/she found involved in the promotion of another Company, Directly or indirectly & any act against Company. Termination, means all monetary Benefits, Rewards, Identity No. & rights will be seized.
78. For any computer generated report required by ISD, Rs.10 per page will be charged.
79. The attempt and interruption by any ISD or non-ISD with wrong intension of making harm by technical side to the company’s software & website for his/her personal monetary or other benefits will be considered as a serious & punishable crime.
80. 5% Data Maintenance charges will be deducted on every Gross Commission Voucher.
81. The Payout will be released after closing that month minimum of 10 days, Maximum of 15 days & on any natural calamity or any typical circumstance it might be 30 days & above.
82. The P.V./B.V. on stationary items will be applicable only if the stated quantities are purchased in a bill.
83. Any kind of fee charged is non-refundable in any condition whatever the case may be.
84. Products once sold will not be taken back in any condition.
85. The calculation of P.V./B.V. will be made in the month in which the items are purchased.
86. All Distributors can purchase the product for P.V./B.V.
87. Only Distributor is authorized to purchase the product for P.V./B.V.
88. The transportation charges/courier will be borne by Distributor and above.
89. The M.R.P. includes CST/RST as applicable.
90. The courier charges will be borne by the company only if the purchase order exceeds Rs.50,000.
91. One should pay advance (D.D./Cash) for direct purchasing.
92. The D.D. should be in the favor of Sunway Sales Pvt. Ltd. payable at Pune.
93. The products once purchased will not be replaced.
94. The product once sold will not be returned whatever the case may be.
95. The delivery of products is subject to availability & Transportation. However, our endeavor would be, to send as earlier as possible.
96. The MRP is subjected to market fluctuation and the PV/BV will change accordingly.
97. To get monthly commission 200/- monthly purchase is mandatory.
98. The kit will be released after the date of joining the business within minimum of 10 days, maximum of 30 days, & in few unforeseen hurdles & Natural calamities it might be 30 days & above.

Note : If a person failed to achieve required targets within stipulated time mentioned in brochure but in case if he achieves the subsequent targets within the stipulated time mentioned, than

He/she shall only be entitled for the rewards of subsequent stage and will not be entitled by any way for the previous rewards which he failed to achieve in the given stipulated time.

1. As a Holder of Pick-Up Center or Sunway Hub, you will have a relation with company only of Business. There is no relation of Holder & company as an employee & employer. Any type of fix amount will not be paid by company.
2. The income of Holder of Pick-Up Center or Sunway Hub is based on his own performance, hard working, sales & Business.
